Terms and Conditions

Welcome to Hartsford Academy, a premier UK-based educational institution offering online courses in financial trading analysis, market research, and related disciplines through our websites hartsford.co.uk and hartsford.org. These Terms and Conditions ("Terms") govern your use of our websites, services, and courses, forming a legally binding agreement between you ("you," "user," or "student") and Hartsford Academy ("Hartsford," "we," "us," or "our"). By accessing our websites, registering for a course, or using our services, you agree to be bound by these Terms in their entirety.

We strongly encourage you to read these Terms carefully before engaging with our services. If you do not agree with any part of these Terms, please refrain from using our websites or enrolling in our courses.

1. About Hartsford Academy

Hartsford Academy is dedicated to providing high-quality online education, specializing in financial trading analysis and market research. Our courses are delivered through our secure learning management system (LMS) hosted on hartsford.co.uk and hartsford.org. These Terms apply to all users, including students enrolled in our courses, prospective learners browsing our websites, and visitors accessing our content. Our mission is to deliver accessible, professional, and engaging educational experiences while ensuring compliance with UK laws, including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

2. Scope of These Terms

These Terms govern your access to and use of our websites, online courses, and related services, including but not limited to course materials, webinars, downloadable resources, and customer support. They outline your rights and obligations as a user, as well as our responsibilities as the service provider. By registering for a course, creating an account, or accessing our websites, you agree to comply with these Terms, our Privacy Policy, and any additional policies referenced herein. These Terms also cover your interactions with third-party services integrated into our platform, such as payment processors or learning management systems.

We reserve the right to update these Terms at any time. Any changes will be posted on our websites with an updated "Last Updated" date if the changes are significant. Your continued use of our services after such updates constitutes acceptance of the revised Terms.

3. Account Registration and Security

To access our online courses or certain features of our websites, you must create an account by providing accurate, complete, and up-to-date information, such as your full name, email address, and a secure password. This information allows us to verify your identity, provide access to course materials, and communicate with you about your enrollment. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

We reserve the right to suspend or terminate your account if we believe you have provided false information, engaged in fraudulent activity, or violated these Terms. In such cases, you will be notified, and any applicable refunds will be processed in accordance with our Refund Policy.

4. Course Enrollment and Access

Our courses are delivered online through our learning management system, accessible via hartsford.co.uk and hartsford.org. Upon enrolling in a course, you will receive a non-transferable, non-exclusive license to access the course materials for personal, non-commercial use. This license grants you access to videos, quizzes, downloadable resources, and other content for the duration of your enrollment, as specified at the time of purchase.

Course access periods vary depending on the course type (e.g., self-paced or cohort-based). Self-paced courses typically provide access for 12 months from the date of enrollment, while cohort-based courses may have a fixed duration aligned with the course schedule. You will be informed of the access period at the time of purchase. We reserve the right to modify or discontinue courses at our discretion, but we will ensure that enrolled students can complete their courses or receive a refund, as outlined in our Refund Policy.

You agree to use our courses and materials in accordance with these Terms and applicable laws. Unauthorized sharing, copying, or distribution of course content is strictly prohibited and may result in account termination and legal action.

5. Payment Terms

Course fees, subscription costs, and any additional charges are clearly outlined on our websites at the time of purchase. All prices include applicable taxes, such as VAT, as required by UK law. We accept payments via secure methods, including credit/debit cards and bank transfers, processed through trusted third-party providers like Stripe and PayPal.

Payments must be made in full before you can access a course, unless you have opted for an installment plan (if available). Installment plans require you to make regular payments as agreed, and failure to do so may result in suspension of course access until payments are up to date. We reserve the right to charge interest on overdue payments at a rate of 4% above the Bank of England base rate, as permitted by UK law.

If you are eligible for a refund, it will be processed in accordance with our Refund Policy. For example, under the Consumer Contracts Regulations 2013, you may have a 14-day cooling-off period to cancel your enrollment and request a full refund, provided you have not accessed significant portions of the course content. Full details are available in our Refund Policy.

6. Intellectual Property Rights

All content provided on our websites and within our courses, including but not limited to videos, text, images, quizzes, downloadable resources, and software, is the intellectual property of Hartsford Academy or our licensors. This content is protected by UK and international copyright, trademark, and intellectual property laws. As a user, you are granted a limited, non-exclusive, non-transferable license to access and use this content for personal, non-commercial purposes during your enrollment period.

You are strictly prohibited from copying, reproducing, distributing, modifying, or creating derivative works from our content without prior written permission from Hartsford Academy. For example, you may not share course videos, download and redistribute course materials, or use our content on other platforms. Unauthorized use may result in account termination, loss of course access, and legal action to protect our intellectual property rights.

If you create content as part of our courses (e.g., forum posts or assignments), you grant Hartsford Academy a worldwide, royalty-free, non-exclusive license to use, reproduce, and display such content for educational purposes, such as improving our courses or promoting student engagement. You retain ownership of your content but agree to its use within our platform.

7. User Conduct and Responsibilities

As a user of our websites and services, you agree to conduct yourself in a lawful, respectful, and ethical manner. Specifically, you agree not to:

  • Engage in fraudulent activities, such as using stolen payment methods or misrepresenting your identity.
  • Attempt to gain unauthorized access to our systems, including through hacking, reverse engineering, or exploiting vulnerabilities.
  • Share, copy, or distribute course content without permission, including sharing login credentials with others.
  • Post or share content that is offensive, defamatory, obscene, or violates the rights of others, including copyright or privacy rights.
  • Use our services for commercial purposes, such as reselling course access or content, without our consent.
  • Engage in behavior that disrupts our services, such as spamming forums or overloading our servers.

Violation of these rules may result in immediate suspension or termination of your account, forfeiture of course access, and potential legal action. We reserve the right to investigate any suspected violations and cooperate with law enforcement authorities if necessary. If you witness or experience inappropriate behavior, please report it.

8. Cancellation and Termination

You may cancel your course enrollment within the 14-day cooling-off period provided by the Consumer Contracts Regulations 2013, provided you have not accessed significant portions of the course content (e.g., watched more than 10% of the course videos). To cancel, contact us with your account details and a clear request to cancel. Refunds will be processed in accordance with our Refund Policy.

We reserve the right to terminate your access to our services if you violate these Terms, fail to make required payments, or engage in conduct that harms our platform or other users. In such cases, you will be notified via email, and any eligible refunds will be processed based on our Refund Policy. Termination does not relieve you of any obligations incurred prior to termination, such as outstanding payments.

If we discontinue a course or cease operations, we will provide enrolled students with reasonable notice and either allow completion of the course or offer a pro-rata refund for the remaining access period.

9. Limitation of Liability

Our courses, particularly those in financial trading analysis, are provided for educational purposes only and do not constitute financial, investment, or professional advice. While we strive to ensure the accuracy and quality of our content, we do not guarantee specific results or outcomes from applying the knowledge gained in our courses. Financial trading involves significant risks, and you should consult a licensed financial advisor before making investment decisions.

To the maximum extent permitted by UK law, Hartsford Academy, its affiliates, and its employees are not liable for any direct, indirect, incidental, or consequential damages arising from your use of our services, including but not limited to financial losses, data loss, or interruption of access. Our liability is limited to the amount you paid for the course or service in question. This limitation does not affect your statutory rights under the Consumer Rights Act 2015.

We are not responsible for technical issues beyond our control, such as internet outages, device failures, or third-party service disruptions, that may affect your access to our courses. However, we will make reasonable efforts to resolve any issues within our control.

10. Third-Party Services

Our services rely on third-party providers to deliver a seamless experience. These include:

These providers operate under their own terms and privacy policies, which we encourage you to review. We are not responsible for the actions or policies of third-party services, but we ensure they comply with UK data protection laws through contractual agreements.

11. Force Majeure

Hartsford Academy is not liable for any failure to perform our obligations under these Terms due to events beyond our reasonable control, known as "force majeure" events. These include natural disasters, wars, riots, strikes, pandemics, internet outages, or power failures. If such an event occurs, we will notify affected users and make reasonable efforts to restore services or provide alternative solutions, such as extended course access or refunds, as appropriate.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of England and Wales. Any disputes arising from or related to these Terms or our services will be subject to the exclusive jurisdiction of the courts of England and Wales. However, we aim to resolve disputes amicably through direct communication. If you have a concern, please contact us to discuss a resolution before pursuing legal action.

In accordance with the Consumer Contracts Regulations 2013, you may also use the EU Online Dispute Resolution (ODR) Platform for resolving disputes related to online purchases, though this is optional and does not affect your statutory rights.

13. Amendments to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or operational practices. Updates will be posted on our websites with a revised "Last Updated" date. Your continued use of our services after such updates constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically to stay informed.
